    Course Description:

    In this new seminar, Mark Weisleder, LLB., REI, teaches what a Realtor needs to know
    about Family Law when representing married or common law couples.
    The objectives of this course are to understand:

    a) How to properly protect yourself when a couple who is separating approaches
    you to sell their property

    b) The differences when representing a married couple or a common law couple,
    when listing or signing the agreement of purchased and sale

    By the end of this session, you will have a comprehensive understanding of the various scenarios that can arise when dealing with properties in the context of separation and marriage. You will learn who is required to sign your listing in cases involving a matrimonial home or an investment property. The session aims to clarify the legal rights of common law couples compared to married couples when they separate, and you will gain insight into why a matrimonial home is considered a unique type of asset.

    Moreover, you will discover whether common law spouses have any rights to property when their names are not registered on the title. The course will guide you on the appropriate actions to take when a separating couple wishes to have individual agents represent them in the sale of their property.

    You will also learn about the necessary disclosures if there is a possibility of one partner buying out the other during a bidding war instead of proceeding with a sale. Additionally, the session will cover the intricacies of writing a co-listing agreement, particularly focusing on unexpected events, such as when an unrepresented buyer expresses interest in a listing.

    A critical aspect you will understand is the potential consequences if only one spouse signs a Buyer Representation Agreement (BRA) with you while the other spouse enters into a purchase agreement without your knowledge. Finally, the session will explain how and when a spouse should provide consent to the agreement of purchase and sale when they do not appear on the title.
